论道地药材的地理标志保护

摘　　要：道地药材与我国特有的地理文化背景及中医药理论有关,是我国独有的提法。因其有效成分高和临床疗效显著,倍受医药界和药材市场的青睐。道地药材的市场需求巨大,但是在产销等环节存在着诸多问题,影响了道地药材良好的口碑和其经济价值的实现。地理标志与道地药材在内容的自然属性和人文属性、主体的集体性上有着明显的契合,因此可以通过地理标志制度来保护道地药材所具有的无形价值。现有三种地理标志制度体系对道地药材进行保护,但三者相互之间在适用上几乎没有协调合作,在应用和执法过程中也存在问题,甚至是冲突,因此急需对三种制度体系进行协调整合。Chinese Geo - herbalism which is in connection with our geographical culture and the theory of traditional Chinese medicine, is a particular concept in the world. Because of its higher effective element and good clinic ef-fectiveness, Chinese Geo-herbalism is favored by consumers and the market. Although its requirement is large, there are a lot of problems in the production and marketing, which has affected its public praise and economic val-ue. There is harmony between Geographical Indication and Chinese Geo - herbalism on the content and main body, so Chinese Geo- herbalism can be protected by Geographical Indication. However, there are three Geographical Indication law systems to protect Chinese Geo - herbalism and they have no Coordination between each other. Thus, problems and even conflicts have occurred in the application of law. Therefore, these three Geographical Indication law systems should be coordinated.
