摘　　要：WTO区域贸易协定透明度机制自2006年年底临时适用以来,已经逐渐得到WTO成员方的广泛认可。然而,机制的运行仍存在潜在的危险,面对日益增多的区域贸易协定,现有的善意履行和"同伴压力"的监督机制,会在未来的运行中遇到前所未有的巨大挑战。而机制一旦被破坏,则意味着多边贸易体制和区域贸易体制的融合进程将被中止。目前透明度机制在实践中已经暴露出监督不力的问题,区域贸易协定通报和审议时间上的拖沓、数据提交上的困难,都督促WTO成员方尽快完善现有的内部监督机制。因此,明确并简化现有WTO规则,建立一个完备的规则评估机制,并扩大WTO秘书处职权,形成后区域贸易协定通报监督框架,是保证今后透明度机制良好运行之必须,也是未来区域贸易协定谈判的主要方向。Transparency of the WTO's RTA has been approved by the WTO members since its implementation on a provisional base in December 2006.However,potential danger is accompanied by the operation of the mechanism.As the numbers of RTAs are increasing rapidly,the current transparency mechanism will confront greater challenges in the future.Once the transparency is messed up,the integration of the multilateral trading system and regional treading system will be suspended.Recent practices have revealed the problems of the existing mechanism,and the WTO members are urged to perfect it.Nevertheless,given transparency as an essential realization of the WTO's good management,members should take the transparency problems into account.In order to ensure a good transparency in the future,it is important for all the members to focus the negotiation on clarifying and simplifying the existing WTO rules,establishing a complete regulatory assessment system.Meanwhile,the WTO members should also pay attention to enhancing function of the WTO secretariat,and shaping a post-notification supervision framework of the RTAs.
