摘 要:民间融资犯罪本质上属于经济犯罪,其发生和演化受制于经济发展状况和行政规制能力。受刑法谦抑性、经济犯罪特点、刑罚自身功能局限等因素影响,刑法对民间融资犯罪的治理应当极为谨慎。在治理理念上,要将民间融资所涉犯罪界定为二次违法;要将被害人过错作为酌定量刑情节减缓罪犯的恶害评价;要强调刑罚的轻缓化,重视刑事责任的多样化。在刑法改革上,应当通过修正个罪构成、充实资格刑内容、扩大刑事责任形式等方法进一步规范犯罪治理制度。Crimes in the private financing are actually economic crimes, whose occurrences and evolutions are subject to the economic development and the administrative regulation capacity. Restrained by the humility of the Criminal Law, the characteristics of economic crimes, and the penalty' s functional limitations, the governance of the Criminal Law on crimes in private financing should be handled in an extremely cautious way. On the concept of governance, crimes in private financing are defined as the second offense. When they are punished, the victim' s fault should be considered as a circumstance of discretion of punish- ment to reduce criminal law evaluations of malicious harm behaviors. At the same time, penalty mitigations and diversified criminal responsibilities should be paid attention to. In the Criminal Law reform, we ought to further standardize the criminal governance through amending the criminal constitution, enriching the content of the qualification penalty, and expanding the forms of criminal liabilities.
