摘　　要：我国学界对器官移植犯罪问题的研究分为起步、稳步发展和快速发展三个阶段,围绕器官移植刑法问题的论文较多,但还没有专门研究器官移植刑法问题的著作问世,直接以"器官移植刑法问题"为主题的国家科研项目也是空白。学界对器官移植刑法问题的研究主要集中在器官移植所带来的犯罪问题及其刑法效应,具体包括现行法律规制器官移植犯罪所存在的问题、器官移植所涉及的刑事犯罪类别、器官移植的正当化条件和根据、器官移植犯罪的现实应对路径、器官移植犯罪的立法完善、脑死亡与器官移植以及器官移植所关涉的其他刑法问题,但现有研究喜忧参半,期待将来不断改进。In the academic circle of China, there exists three stages on the criminal law issue of organ transplantation： starting ,stage, steady development stage, and the rapid development stage. There are plenty of papers about the criminal law issue of organ transplantation, however, there haven＇t had specialized works studying on the criminal law issue of organ transplantation, and the national research projects with the theme of ＂the criminal law issue of organ transplantation＂ are rare to see. Academic circles who study criminal law issue of organ transplan- tation mainly concentrates on the crime and the criminal effect of organ transplantation, including the problems of the current laws regulating the crime of organ transplantation, criminal categories of organ transplantation, legiti- mate conditions and bases of organ transplantation, the way to deal with the reality of the crime of organ trans- plantation, legislative perfection about organ transplantation crime, brain death and organ transplantation, and oth- er criminal issue that organ transplantation involved. The present research about it mingles hope and fear, it is expected to improve continuously.
