《中医药条例》的立法原则之不足与完善建议

摘　　要：随着我国医药卫生事业的改革和发展,《中华人民共和国中医药条例》已经不能完全适应中医药事业发展的要求。本文针对该条例中立法原则的不足之处,提出在修改该条例时,应当遵循六项原则:坚持中西医并重、把中医药与西医药摆在同等重要的位置;坚持继承与创新的辨证统一,既要保持中医药特色优势又要积极利用现代科技;坚持中医与西医共同发展,相互取长补短、发挥各自优势;坚持统筹兼顾;坚持发挥政府扶持作用,动员各方面力量共同促进中医药事业发展;中医药事业的发展必须遵循卫生改革与发展的原则。With the development and reform of medical and heahhcare services in China, Chinese Medicine Ordinance of the People ＇s Republic of China can not completely adapt to the requirements of the development of Chinese medicine. Therefore, it needs amending because of the deficiencies in its legislative principles. This pa- per puts forward the following 6 principles to follow while we do the amending： paying equal attention to tradi- tional Chinese and western medicine, since the traditional Chinese medicine and western medicine are of the same importance; adhering to the dialectical unity of inheritance and innovation, not only keeping the special advantage of Chinese medicine but also using modern technology actively; adhering to the common development of tradi- tional Chinese medicine and western medicine, the mutual complement to each other and playing to their respec- tive advantages; adhering to the overall consideration; giving full play to the government＇s supporting role, mobi- lizing strength from various fields and jointly promoting the development of Chinese medicine cause; following health reform and development in developing traditional Chinese medicine.
