德法两国弱势群体立法保护对我国的启示

摘　　要：作为典型的福利型国家,德法两国在弱势群体立法保护方面有其值得借鉴的地方,但由于经济增速缓慢、失业率居高及金融危机等因素的影响,其社会保障体系也存在社会保障超越国家财政能力及社会保障发展失衡等问题。通过比较德法两国弱势群体保护的利弊得失,并以此反观我国弱势群体立法保护的不足。实践中,应通过完善弱势群体立法保护体系、加强法律协调性、扩大社会保障覆盖面、缩小地区差异、提高弱势群体的社会保障层次等措施强化我国弱势群体的保护。A lot of enlightenment can be drawn from the legal protection for the weak groups in Germany and France, two typical welfare countries. There are also the problems that the social security is beyond the national financial capacity and imbalance of the development of social security due to slow economic increase, high rate of unemployment, and the financial crisis. A lot of enlightenment can be drawn from the legal protection for the weak groups in Germany and France through comparing their advantages and disadvantages, which is to show the disadvantages of the legal protection for the weak groups in China. The legal protection for the weak groups in China can be strengthened by bettering the law system of the legal protection for the weak groups, enhancing the harmony of laws, widening the social security system, shortening the regional differences, and improving the level of social security for weak groups.
