摘　　要：法律的正义只有通过正当程序才能得到真正的实现 ,而实现这一目标则必须依靠良好的刑事执法环境。如果有了一个好的法律而又不认真执行 ,或者由于司法机关和执法人员主观方向的失误而在执行中出现偏差 ,则根本谈不上“依法治国”因此 ,创造优化的刑事执法环境 ,是实现法治的重要保障 ,这不仅是历史的要求 。The only effective way of realizing legal justice is resorting to due process,and to reach this target,a good criminal law enforcement environment is essential.A good legislation without effective enforcement is no worth,and to talk about ‘principle of administering the country according to law’ in such a context is also good for nothing.Thus,to optimize the criminal law enforcement environment is an important safeguard of legality which is not only the requirement of history but also the call of the time.
