摘　　要：在当前经济发展和民生改善的背景下,研究经济法的经济社会二元功能之平衡问题尤为必要。经济法的功能可以从多个角度进行审视。经济法的经济功能与社会功能构成了经济法上的二元功能体系。经济法的经济社会功能之间不仅具有同向性,同时也具有一定程度的异向性。经济法的经济社会功能的冲突在经济法作用的各个具体领域都有一定的体现,这种冲突的加剧将会导致经济与社会的断裂,带来严重的后果,很有必要加以平衡。经济法的经济社会功能冲突的平衡可以从两个方面入手,一是通过经济法与其它部门法的外部配合来平衡,二是通过经济法的内部调整来实现。In the current background of economic development and improving the livelihood of people,it is necessary to study the balance of economic and social dual function of economic law.The function of the economic law can be surveyed in multiple perspectives.The economic function and the social function of the economic law constitute the dual function system of economic law.The economic and social function of economic law not only can in one way,but also can be in different ways.The conflict between the economic and social function of economic law can be reflected in various branches of the economic law.When this kind of conflict is intensified,the relationship between economy and society will rupture and the consequence is serious.So it is necessary to try to balance them.The balance of the conflict can be done from two aspects.One is the external balance through the cooperation of economic law and other legal branches,and the other is the internal adjustment of the economic law.
