摘　　要："媒体审判"一词源于西方,原本是指媒体关于未决案件先入为主的报道对陪审员产生的主观不利影响,从而导致审判有失公正的后果。目前在我国虽然不存在陪审团制度,但是"媒体审判"现象也存在愈演愈烈的趋势。本文分析了媒体审判的心理机制,介绍了美国司法对于媒体审判的规制并论证了我国应采取的相应对策,以期达到防范媒体审判的最终目的。The word of ＇ trail by media＇ stem from the western countries, which originally meant the disadvantageous subjective effect and unjust outcome of judgment to the juror by the anterior report by media. In present China, though there is no jury trail, the trend of ＇trail by media＇ is increasing. The essay analyzed the psychological mechanism of ＇ trail by media＇ and introduced the regulation to it in the judicial system of USA. Besides, the countermeasures that should be adopted in China was proposed to keep watch the negative effect by ＇ trail by media＇ .
