摘 要:香港特区的船舶扣押制度沿袭于英国,在香港回归后继续适用。海事请求权人既可在行使船舶物权、船舶优先权或普通海事请求权的对物诉讼中申请扣船,也可在对人诉讼中申请扣船,但各自的条件有差别,与内地的相应做法也存在差异。同内地的扣船制度比较,其在申请人的负担、程序的简捷等方面具有优势,但在扣船范围、司法担保功能等方面有其不足。The ship arrest law of HKSAR originated to China. The maritime claimer may apply to the court to maritime liens and the general maritime claims in actions from UK, and continues in use after Hong Kong returned arrest a ship in order to execute the right of ship in rem, in rem, or apply for the arrest of a ship in actions in personaml But there are different terms and conditions in these two procedures, and the terms and conditions of HK SAR are different from those of China's Mainland. A comparison of the ship arrest system between HKSAR and Main land China indicates the ship arrest procedure of HKSAR is simpler and more efficient, and creates less legal bur den for the applicants, but it is defective in the scope of ships arrestable and the function of judicial guarantee.
