论人大对检察机关诉讼职权的动态监督

摘　　要：人大是国家权力机关,享有法律监督职权,在我国现有体制下充分发挥其监督职能,对检察院诉讼职权进行有效监督,无疑是保证检察院诉讼职权正确运行的最佳途径。人民检察院是我国的法律监督机构,享有的法律监督权是我国权力分配的结果。但是,对人民检察院的职权如何监督存在缺失,尤其是对检察院的诉讼职权缺少法律监督环节。因此,检察机关要享有对案件直接侦查、起诉的法律权力,必须解决如何监督其诉讼职权正确行使的问题。The National People＇s Congress is the organ of state power;legal supervision power; in our country existing system to give full play to the function of supervision;the proeumtorate Litigation Authority Supervision;is undoubtedly that procuratorate litigation powers correctly the best way.Tbe people＇s procuratorate is our country＇s legal supervision institution;enjoys the right of legal super- vision is China＇s power distribution results.However;the people＇s Proeuratorate＇s authority to supervise the deficiencies;especially the lack of legal supervision of procuratomte Litigation Authority link;does not comply with the principle of separation of powers and checks and balances.Therefore;procuratorial organs should enjoy the right of investigation;prosecution of cases directly to the power law;must solve how to supervise itslitigation authority exercising problem.
