摘　　要：文章结合WTO的"SCM协议"中补贴专向性的规定,指出我国目前新能源产业政府补贴存在以下问题:多数补贴集中在部分企业或项目,极易构成补贴的事实专向性;新能源产业中各细分领域缺乏科学全面的补贴标准;繁杂而缺乏统一规划的各类补贴极易遭到反补贴起诉等。对此,文章在借鉴美国关于补贴专向性认定经验的基础上,提出完善我国新能源产业政府补贴的应对之策,主要包括:明确我国反倾销反补贴条例中对补贴专向性的规定;主要通过税收环节的扶持进行政府补贴;证明我国是合格的发展中国家成员;争取将新能源产业的补贴问题纳入未来WTO的谈判议题,倡导对新能源产业补贴给予豁免,提倡确定更为宽松的专向性审查标准,等等。By researching of the regulations of specificity of subsidy in WTO ＂SCM protocol＂, the paper points out the following problems of our government subsidy policies on new energy industry. Most subsidies are given to a little enterprises or projects which is extremely easy to be considered the actual specific subsidies;more science and comprehensive subsidies standards on various segments o{ new energy industry are in urgent needed~ the complexity and without unified planning make the various subsidies vulnerable to countervailing prosecution. On the foundation of lessons draw from the United States＇s determination of the specificity of a subsidy, the article further suggests that China government should perfect the policies of government subsidies on the new energy industry on basis of full understanding of WTO and ＂SCM protocol＂. We should make the relevant provisions of specificity subsidies in China＇s anti- dumping and anti-subsidy regulations more clare. The government subsidies should be achieved mainly through tax revenue. We need to prove China is qualified member in developing countries, support the new energy industry subsidies into future negotiation issues of WTO, advocate granted immunity for new energy industry subsidies, and promote more relaxed specificity review standard, etc.
