略论侦查目的的应然选择

摘　　要：侦查目的研究对刑事司法改革及侦查学本体研究具有重要意义,但对侦查目的的研究,不应局限于刑事诉讼法的藩篱中进行思考,更多思量应从多层次视角去解读。从刑事法视角而言,侦查目的应当是预防犯罪和保障公众权益;从侦查本体视角而言,侦查目的由侦查程序目的和侦查实体目的两部分组成。侦查程序目的是由善的价值追求所决定,侦查实体目的则是构建和谐社会内在需求所决定。The study of investigation purpose attaches great importance both to the Criminal Justice Reform and the investigation ontology study. However, Investigation purposes can not be confined to the barriers of the Code of Criminal Procedure and consideration should be put on the multi - facet perspectives of interpretation. From a crim- inal law perspective, the purpose of the investigation should be the prevention of crime and the protection of public interests ; from the investigation in terms of the ontological perspective, the investigative purpose of the two parts of the investigation of procedures for the purpose of investigation of entity purpose.
