摘 要:食品检验是判断食品是否符合安全标准的重要手段。我国有两种意义上的食品检验行为,即民事行为性质的食品检验和行政行为性质的食品检验;根据行政法原理,后者的效力优先于前者,且后者具有公定力、拘束力,因此,撤销此意义上的食品检验行为必须依据合理事由和程序。基于参与型行政理念,为更好保护消费者合法利益,并改善我国食品安全形势,应赋予消费者在食品检验过程中一定的参与权,合理构建消费者的利益表达和权益维护机制。Food inspection is an important means to determine whether the food complies with safety standards. There are two connotations in the food inspection behavior in China, the food inspection behavior with civil attributes and that with administrative attributes. According to principle of administrative law, the food inspection behavior with administrative attributes has prior effect, which has presumptive legality and binding force. Revoking the food inspection behavior with administrative attributes must be based on a reasonable subject matter and procedures. Based on participative administrative philosophy, a certain right to participate in the food inspection process should be given to consumers and it is necessary to establish the mechanism for the consumers to express and safeguard their interests.
