有关民族与“民族性法”的几点思考

摘　　要：建构于近代民族国家基础上的世界格局,从根本上将民族的演进历程区分为王朝帝国的民族阶段与民族国家的民族阶段。伴随着全球化程度的加深,人类的民族形态与民族关系叉进入了一个新的历史时期——"后民族时代"。王朝帝国的民族阶段的法是宗族性法,民族时代的法是"民族性法"尽管民族性法在当下世界各国国际国内都还有着现实基础和实际影响,但"后民族时代"的民族与法律的总体关系已经出现了对民族性法的一系列新的修正和要求。According to the world pattern based on modern nation-states, the evolutional process of ethnic groups can be divided into ethnic-group-stage of the empire and ethnic-group-stage of the nation state. As the process of globalization deepened, forma- tion and relationship of the ethnic groups of human beings entered a new period of history--＂ era of the post-ethnic-group＂. There was the law of Clan-ism in the stage of the Empire and the law of nationality in the stage of nation states. Although there are actu- al bases and factual impacts on the foundation of the law of nationality, the general relationship between nations of ＂the era of post-nation＂ has made a series of revisions due to the requirements of the law of nationality.
