论从源头上治理监狱民警职务犯罪

摘　　要：职务犯罪的本质是权力的滥用或不正确使用,其源头是异化的公权力运行。监狱民警职务犯罪是监狱中行政管理权、执法权行使过程中的异化。根据公权力运行规律,只有在"治理"理念的指导下,采取一系列措施,建立开放、科学的决策机制,消除异化权力的非正当性目的,引进多主体参与行权,打破异化权力得以实现的自满足结构,建立监狱工作与多方社会组织的流畅交流,打破监狱系统封闭的行权环境,才能从源头上治理监狱民警职务犯罪。The nature of duty criminal lies in an abuse or improper use of power, which originates from the operation of dissimilation of public power. Duty criminal of prison guard is dissimilated during the oper- ation of administrative power and of enforcement power. According to the operation laws of public power, a series of measures should be adopted to set up an open and scientific decision-making mechanism,to elim- inate illegitimate purpose of dissimilative public power, to introduce more participates in exercising the power, to break the self-satisfied structure of judicial authority dissimilation, to establish the smooth com- munication among the prison and social organizations, to break through the closed enforcement environ- ment of jail system and then to be able to control the duty criminal of prison guard in the source.
