专利池优势探析

摘　　要：伴随着发达国家主导下的标准之争愈演愈烈的趋势,专利池逐渐引起我国社会各界的重视,学界对专利池的研究也日益深入。在分析专利池研究现状的基础上,指出现阶段研究专利池正负效应存在比例失调的弊病,并倡导学界应着眼于专利池积极作用的研究。从专利池的天然优势、专利池的积极效应、专利池的终极追求三个层面来构建专利池优势系统,最后凝成一张专利池优势效力层级图,进而揭示出专利池对提升一国产业竞争力的巨大推动作用。In recent years, as the battle of standards under the auspices of developed countries intensified, patent pool has been drawing the attention of our community gradually, and so have the academic circles. On the above analysis, the paper points out the shortcomings of imbalance of positive and negative effects. On the contrary, it proposes that we focus on the positive effect of the patent pool. The next, the paper constructs a system of advantage of patent pool from three levels： the natural advantages of the patent pool, the positive effects of patent pool, the ultimate pursuit of patent pool. He completes a picture of the effect level of patent pool at last. By this, he reveals the important role of patent pool that it can strongly promote market competitiveness.
