摘　　要：在一个民主和法治的国家,民主监督既合理又正当。但合理正当的民主监督却离不开相应的条件。在观念上,民主监督不是取决于被监督者是否愿意;在政治上,取决于权力授予制度是否真实;在法律上,取决于公民基本权利保障是否合理规范;在司法上,取决于违宪机制的确立。只有在观念、政治、法律和司法四个条件都具备的时候,民主监督才会成为现实。In a democratic and legal country, democracy supervision is both reasonable and legitimate, which needs the following conditions. In conceptual sense, democracy supervision is not determined by the will of the supervisee, while the democracy supervision is effective as the power comes from institutions in political view. And to guarantee the citizens＇ basic legal rights in proper and normal way also contributes to the democracy supervision. In judiciary sense, an effective democracy supervision relies on the establishment of the rules on the obeying against the constitutions. Until the conditions concerning the idea, politics, law and justice are available, the democracy supervision will not become a reality.
