摘　　要：组织未成年人进行违反治安管理活动罪是一项侵犯公民人身权利的犯罪,对本罪构成要件的解释不能脱离对其法益的理解。"组织行为"可以表现为暴力、胁迫、雇佣、引诱、拉拢等方式实施;"违反治安管理活动"不仅包括一般违反治安管理的行为,还包括犯罪行为;不仅包括应受处罚的违反治安管理的行为,还包括不受处罚的纯客观的违反治安管理的行为;本罪与共犯的竞合问题应根据未成年人的年龄及犯罪的数额大小具体分析。Organizing activities of minors＇ violating security management is a crime violating the civil right.The interpretation of the constitutional elements of this crime can not be divorced from its legal interests.＂Organization behavior＂ can be expressed as violence,coercion,employment,inducement,etc.＂Violation of security management＂ includes not only the ordinary acts,but also the criminal acts;not only the acts subject to punishment,but also the purely objective acts not subject to punishment.The complicity of the crime should be analyzed on basis of the age of the minor and the amount of the crime.
