基于控制权的农地流转中三维权益结构与运营分析

摘　　要：农地作为一项资产是物质载体和一定权利的结合体。不同主体权利的行使是以追求和维护某种利益为目的的,权益就是权利中的利益,利益是设置产权的基础。在农地流转中通过合理地界定和安排产权的结构,发挥产权的激励、约束和分配功能,可以降低市场交易过程中的成本,提高运营效率,优化农地资源配置。文章着眼于农地规模经营和权益实现的角度,强调农民是农地使用权层面上的相对独立的产权保持人,提出农地的控制权束,即把农地产权分解为所有权束、控制权束和使用权束等权益束,而农地的流转事实上主要是使用权束的流转。在此基础上基于制度科层概念模型,对农地运营过程中国家、集体和农户三个层次中不同利益主体的行为进行分析。Being an asset, the farmland combines the material carrier and rights. A reasonable definition and arrangement of the property right and giving play to the functions of encouragement, restraint and allocation of the property right can reduce the cost of market transactions, raise the operation efficiency and optimalize the allocation of farmland. In light of the scale and the right and interest of farmland, this paper emphasizes that the farmer is a relatively independent owner of the right of use. The right of farmland includes the bunch of ownership, the bunch of control rights and the bunch of use rights. The farmland circulation is mainly the circulation of the bunch of use rights. Then this paper analyzes the three interest subjects -- the state, the collective, and the farmer -- in the process of farmland operations.
