摘　　要：宪法援引过程中的宪法解读,是一个经常性的、同时又常常被忽略的问题。宪法作为国家的根本大法,要得到正确有效的贯彻实施,首先就有一个对宪法进行援引和解读的问题。宪法解读与宪法解释的性质和作用不同的。人们对黑龙江规定风能属国有涉嫌"违宪"的质疑,在很大程度上是混淆了宪法解释与宪法解读的结果。同样,人们对于人民法院在司法裁判中对宪法文本援引问题的争议,其原因也是混淆了宪法援引与宪法适用的区别。宪法有效的贯彻实施离不开对宪法的援引和解读。宪法援引过程中的宪法解读是一个严肃的法律行为,要澄清理论上与法律上的某些误区,在宪法援引过程中的宪法解读问题上,应当合理、规范地运用。The informal interpretation Constitution in the process of invoking constitution is a recurrent, and often overlooked problem. The nature and effects of formal interpretation and the informal interpretation of constitution are different. The ＂unconstitutional ＂ doubt of Heilongjiang＇ s provision of state- owned wind energy and solar energy, to a large extent is due to confusing with the formal interpretation and the informal interpretation of constitution. The controversy of the people~ courts invoke constitutional text in judicial decision is also account of confusing the application of constitution and invoking constitution. The informal interpretation and invoking of constitution are important parts of constitutional application.
