通讯制造业竞争性战略联盟冲突的原因及政府对策研究--基于中兴、华为知识产权纠纷的案例分析

摘　　要：在竞合模式盛行的市场经济中,高技术产业包括通讯制造业竞争企业出于利益分享的理性诉求,大量合作,建立竞争性战略联盟。这种联盟的稳定性和可持续性取决于联盟成员企业之间竞争排斥力和合作向心力的平衡机制。在失衡及冲突产生状态下,企业联盟的维系可能需要第三方包括政府的支持和协调,进而对政府政策的选择提出相应的要求。以华为和中兴两家通讯企业的知识产权纠纷为典型案例,分析这两个竞争性战略联盟冲突激化的原因,探讨政府的介入和协调等问题,并提出政府应对的两类措施:短期应急处置的应对性对策和治本的拓展性对策,以期对竞争性战略联盟冲突的解决提供帮助。Competition and cooperation model is very prevalent in market economy. For the rational demands of benefit - sharing, high - tech industries including communications manufacturing carry out a large number of cooperation, and create competitive strategic alliances. Stability and sustainability of these alliances depend on the balance mechanism of competitive repulsion and cooperation centripetal force between the alliance members. In the state of imbalance and conflict, the maintenance of business alliances may need a thirdparty, including government＇s support and coordination, and thus, require government do some relevant choice of policies. This article will analyze the reasons of conflict existing between competing strategic alliance members, based on the typical case of two communications coinpanies＇ intellectual property disputes between Huawei and ZTE, explore how can government intervene and coordinate, and provide two types of measures to the government ： short - term emergency response to deal with countermeasures and expand countermeasures to root the problem, which can assist the resolution of the conflict of competing strategic alliances.
