论司法鉴定结论的客观性

摘　　要：学界对司法鉴定结论的主观性与客观性一直争论不休,鉴定结论主观论者基于认识论的一般原理认为鉴定结论是一种主观反映客观的东西,虽然内容是客观的,但却赖以主观的形式来表现,因此就势必具有主观性。从而就可以推导出主观因素在鉴定结论中的合法地位,鉴定结论的主观性也就成为一种应然或必然。事实上,鉴定结论主观论者忽视了鉴定过程中鉴定人的主观因素本身就是非法的。鉴定结论作为法定证据的存在基础是鉴定结论必须建立在科学的规律之上。笔者通过对鉴定结论证据的特点、形成过程以及相关立法的深入分析,试图证明鉴定结论的本质属性应该是其客观性,而绝非其主观性。The nature authentication conclusion has long been a controversial issue, those who hold their subjective view may place their theory on the basement of the principle of epistemology. They take it for granted that the authentication conclusion is a kind of reflection of the objectivity through subjective means. They, through this way, deduce the logical status of sub- jective nature in an authentication conclusion. But, actually, they overlook an important point that the intruding of a sub- jective attitude itself in an authentication procedure is illegitimate. As a kind of legal evidence, the authentication con- clusion should be put on the scientific basement. Through the analyzing of the characters and the forming of authentica- .tion conclusion, the author tries to prove that its intrinsic nature is objectivity, but not subjectivity.
