摘　　要：家事纠纷解决机制的研究应以我国社会生活方式与婚姻家庭观念变化为背景,在现有诉讼方式和调解方式并行的纠纷解决机制基础上,了解调查调解制度的现状和存在的问题及困难,探讨如何加强与完善婚姻家庭调解制度,特别是基层社区调解。为促进婚姻家庭调解制度的改革与创新,重构婚姻家庭调解制度和完善家事纠纷多元解决机制,提出完善诉讼模式和调解模式的建议和对策,如设立专门的家事法庭和附设家事调解委员会及制定特殊程序与证据规则,在《民事诉讼法》中增设家事诉讼程序,条件成熟时制定专门的家事诉讼法;应完善与细化婚姻家庭案件调解流程与规则;应将人民调解作为婚姻家庭纠纷案件的前置程序等,以期为相关立法及政策的制定与完善提供法理依据和数据支撑。Research on family dispute resolution mechanism in China is on the background of the change of lif- estyle and people＇ s ideas about marriage and family in contemporary China. It aims at learning Status Quo of the system of conciliation and its problems and difficulties, and discussing how to strengthen and perfect the system of conciliation of marriage and family, especially conciliation of community. In order to facilitate the re- form and innovation of the conciliation system, and to reconstitute this system and perfect the multiple family dispute resolution mechanisms, this essay proposes some suggestions and counter policies, such as the establish- ment of procedure of family litigation, even the legislation of Act of Family Litigation in case of realization of correlative conditions. Meanwhile, the proceedings and rules about family disputes should be refined, and peo- ple＇ s conciliation should be settled as procedural prerequisite, in order that theoretical basis and data can be provided for the correlative enactments and proposals of policies.
