新《民事诉讼法》对民事诉讼检察监督的拓展与规制

摘　　要：新修改的《民事诉讼法》拓展了检察监督的范围,明确了检察建议的法律效力,完善了检察监督的权力结构,强化了检察机关民事抗诉及提出检察建议的实效。同时,虽然检察机关行使民事抗诉权将使人民法院已经生效的裁判暂时中止执行,但为维护司法权威和司法公信力,检察机关对民事诉讼的监督并非可以无限扩张。在完善检察监督的同时,为实现审判权与检察监督权的动态平衡,充分保障当事人的公平审判权,新修改的《民事诉讼法》明确规定检察监督也要受到期限、事由、程序等方面的限制。The newly amended civil procedure law to expand the scope of the procuratorial supervision, procuratorial suggestion clear legal effect, improve the prosecutorial supervision power structure, strengthen the procuratorial organs of civil protest and present procuratorial suggestion effect.At the same time, because the prosecution of civil and administrative right of protest will make people court has come into force the referee temporarily suspended, to safeguard the authority of the judiciary and public credibility of the judiciary, the procuratorial organs of civil supervision is not unlimited expansion, in perfecting procuratorial supervision at the same time, the jurisdiction and supervision in dynamic equilibrium, full protection of the parties the right to a fair trial, the newly amended civil procedure law stipulates procuratorial supervision should also receive, by, procedures and other aspects of limit.
