摘 要:中俄双方司法互助协定和领导人定期会晤制度,并没有在解决中俄贸易纠纷方面发挥应有的作用。现有纠纷解决途径缺乏实效性是边境贸易纠纷解决难的直接原因,而司法主权困扰、司法体制不同、政府未充分重视所导致的边境贸易纠纷解决司法合作机制尚未建立则是其深层原因。建立成熟的纠纷解决机制可以从成立专家小组、签订边境区域法律合作协定、设立口岸法庭、建立边境联合调解机制等方面努力,同时需要注意联合调解这一纠纷解决途径的法律效力、诉讼与调解的对接和非诉讼纠纷解决机构和人员的专业化、规范化问题。The Sino-Russian judicial mutual help agreement and the leader-regular- meeting system do not play a requisite role in the Sino-Russian trade dispute. The present solutions to the trade dispute do not have actual effect, which is the direct cause of a hard solution to the trade dispute. And jurisdiction puzzles, different judicial systems and the governments not giving adequate attention lead to no judicial cooperative mechanism to be established for resolving the frontier trade dispute, which is the in-depth cause. It is essential to set up a mature mechanism to resolve the trade dispute, for example, setting up an expert group, signing a frontier judicial cooperative agreement, setting up a port court and a frontier joint conciliation mechanism. At the same time, it is required to pay attention to the legal effect of the solutions to the dispute, the connection of proceedings and mediations and the specialization and standardization of the institutions and personnel who deal with none-proceeding dispute.
