摘　　要：我国社会主义法律体系已经建成,但还不够完善,需要加强各方面的工作,法律解释就是其中颇具中国特色的一种完善法律体系的方式。法律解释的中国特色主要表现为:解释的结果不仅适用于个案,还普遍适用于所有类似案件;解释主体不仅包括法官,还包括司法机关、行政机关和立法机关;解释对象不仅包括法条,还包括整部法律文件甚至几部法律文件的法律精神。这使得法律解释具有明显的立法性质,并在法律概念澄清与定义、不当法律制度的微调、法律漏洞的补充和法律空白的先行探索等方面发挥着完善法律体系的作用。Chinese socialist legal system has been mature,but it is not perfect.Legal explanation is a Chinese characteristic way to better the legal system.The Chinese characteristics of legal explanation shows: the result of explanation is suitable for not only the individual case,but the similar cases;the subject of explanation includes not only the judges,but the judicial organ,the administrative organ and the legislature;the object of explanation includes not only the regulations,but the legal spirit of whole law document and law documents.Therefore,it makes laws have the obvious quality of legislature,and plays a role in bettering legal system to make a clear definition of legal concepts,make a small adjustment of unsuitable legal system,supplement the legal leakage and explore the legal blankness.
