法律和政策视角下中国与东盟合作领域的扩展及其机制分析

摘　　要：中国-东盟自贸区为浅层次一体化(Shallow Integration),这种状态对于经济合作的深度是有限的,对于双方关系的促进也是有限的。双方应采取扩大合作战略并且以深层次一体化(Deep Integration)方式来进行,扩大合作的领域应该是中国与东盟的知识产权领域、海洋和海事领域、新能源领域、环境保护领域、非传统安全领域、共同惩治跨境犯罪以及劳务领域合作。合作的方式可采取软硬法相结合、法律和政策相结合等途径。China-ASEAN Free Trade Area is cooperating in way of shallow integration,which is limited for the depth of the economic cooperation and the promotion of the relations between the two sides.The two sides should expand cooperation strategies by means of deep integration.And the cooperation should be expanded to the fields of intellectual property,marine and maritime affairs,new energy,environmental protection,non-traditional security,common punishment of cross-border crime and labor service cooperation between China and ASEAN.Pattern of cooperation may take the combination of hard and soft cooperation,and that of law and policy.
