边防拘留审查所执法管理问题研究

摘　　要：边防拘留审查所是公安边防部门从事边防拘留审查的场所,也是公安边防部门执勤执法的组成部分,它不仅担负着对"三非"外国人的拘留审查工作,还担负着对"三非"外国人的移交和遣返工作。但在实际工作中,边防拘留审查所在法律地位、执法依据、管理运行程序、专业人员培养及经费保障等方面存在诸多问题,极大地限制了边防拘留审查所的建设和发展。深入剖析边防拘留审查所执法管理问题,提出具体的应对措施,对边防拘留所的建设和发展具有启示作用。Border detention institute is not only a place where border police engage in border detention but it is also integral part of border police on law enforcement. And they are responsible for the detention, the transfer and repat- riation of alien ＂Three Illegal＂. There exist many problems such as legal status, the basis of law enforcement, opera- tional procedures and training funding et al law enforcement and these factors limits the construction and development of the border detention institute. Some specific measures to deal with the problems were put forward based on the in - depth analysis of law enforcement managements.
