摘　　要：宋代民事息讼在司法中运用之广、方式之多是前所未有的。其主要类型有:化解纷争的财产息讼、辨析伦理的人伦息讼、敦厚宗族的立继息讼、和睦家庭的婚姻息讼。在息讼中,宋代司法官吏追求民事诉讼的终结,采取了整体性的审判思维,灵活运用息讼方式化解各种民事纠纷。宋代富有特色的民事息讼方式在完善民事诉讼程序、保护民事权利、缓解家庭和社会矛盾、促进社会稳定和谐等方面起着重要的作用。Withdrawing a civil lawsuit was unprecedentedly applied to justice practice in a variety of models.The major types included withdrawing a lawsuit in property cases,unsettled disputes among family members,wealth inheritance in big families and marital conflicts.The judges in Song dynasty focused so much on terminating the civil litigation that they conducted integral consideration to settle the disputes.This unique practice played an important role in perfecting the lawsuit procedures for civil cases,protection of the civil rights,relieving the family and social conflicts as well as promoting peace and stability during that period.
