摘　　要：有效利用商事习惯是提升商事审判工作质量的一个必要手段。只有经过一定程序并且得到该程序确认的商事习惯才能够在司法审判中适用。确认商事习惯是在司法中予以合理适用的前提,而有效确认则涉及诸多诉讼及商法本身的理论问题。The effective use of commercial custom is a necessary means to enhance the commercial trial quality.Only through certain procedures and the procedures to confirm the commercial habit can be used in judicial judgment.Confirming commercial custom is in the administration of justice to a reasonable application of the premise,and validation involves many litigation and commercial law theory.
