摘 要:出租车营运方式可以给矿政管理两方面启示:一方面是如何实现所有者权益的问题;另一方面是如何看待驾照和矿业权的本质差异问题。出租车行业确定份金的思路和做法与我们计算矿产资源价值的方法相比简便易行、科学合理,与各矿业大国立足于矿业预期收益分成并进行动态调节确定权利金的思路异曲同工。矿业权制度的"驾照理论"者把"资质"等同于"物权",错把勘查、开采全民所有的矿产资源等同于开自己的车;错把"物权与物"的法律关系置换成"资质与财产"法律关系。吊销驾照的同时能不能收车,实质是行政权与所有权能否主体统一问题。矿业权一经吊销,由原矿业权人保留并限期转让的做法不合理。This paper introduces the two enlightenments gained from taxi operation mechanism on geological mineral administrative management,these are: how to realize the ownership interest;and how to look at qualitative difference between driver's license and mineral rights.The idea and practice of determining bonus in taxi industry is simple and scientific and reasonable relative to the calculation method of mineral resource value;and it is similar to this idea that all countries with great mineral industry will be based on the share of expected returns of mining industry,and determining the royalty can be adjusted dynamically.The theory of driver's license in the mining institutions,which regards the qualification same as property rights,confuses exploration and exploitation of mineral resources under ownership by the whole people for driving their own cars,replaces the legal relations of 'real right and thing' with the legal relations of 'qualification and property' mistakenly.The issue of whether the car can be forbidden to drive when the driver's licenses are revoked is whether the executive powers and ownership has the unity of subject or not in essences.Once the mining right is revoked,the original holder of mining right should not keep or transfer it within a prescribed time.
