我国配偶权制度亟需完善的几个问题——由许某离婚案引发的思考

摘　　要：以许某离婚案切入,剖析我国现行配偶权制度之不足。我国现行配偶权制度存在忠实义务内容过于局限、相互扶助权内容不完善、婚内损害赔偿制度缺失等几个亟需完善的问题。针对这些问题,提出明确性权利、扩大忠实义务请求权范围、扩充相互扶助权内容和延伸扶助权期间等建议,并设想构建婚内侵权赔偿制度。With the divorce case with surname Xu as the example,this article analyzes the shortages of China's existing spouse rights system.The pressing problems of China's existing spouse rights system include very limited duties of loyalty,incomplete rights of mutual assistance,absence of the compensation system for the loss in marriage.To address these problems,the article proposes to make clear the sexual rights,enlarge the rights of claim for duties of loyalty,expand the rights of mutual assistance and extend the period of rights of mutual assistance,and it also envisages to build the compensation system for the loss in marriage.
