摘　　要：对中国国内运输中不同运输方式的旅客人身损害赔偿法律制度进行了比较研究,发现旅客人身损害赔偿法律制度相互矛盾、陈旧过时,导致了法律依据的不确定性及赔偿标准的随意性,从而使各类运输中受到伤害的旅客的利益无法得到充分救济。为此,提出应从六个方面完善中国旅客人身损害赔偿法律制度。A comparative study of the laws and regulations of personal injury compensation on difl＇erent modes of transport in China finds that the laws and regulations are mutually contradictory and outdated that they no longer provide adequate damage compensation to passengers. It is suggested that the laws and regulations must be amended from six aspects to ensure the adequaey and certainty of damage compensation.
