摘　　要：家事纠纷的独特性要求建立一个与之相对应的专门的解决机制,而社区作为最基层、最贴近群众的组织,对家事纠纷的解决具有其独特的作用。但是随着社会的发展,法制观念的深入以及社区组织建设的缓慢发展,家事纠纷不断涌入诉讼中,社区在家事纠纷解决中的作用难以体现,在社区中建立专门的家事纠纷解决机制显得越来越重要。而我国社区组织建设中家事纠纷解决现状存在诸多弊端,借鉴域外家事纠纷解决的经验,结合我国的国情,认为应当在社区人民调解委员会之中建立专门的家事纠纷解决机构,同社区相互协作,防治结合,并建立强制性的调解制度,调解与诉讼相互协调,力求在我国的社区中建立一个相对完善的专门的家事纠纷解决机制。The unique nature of family dispute requires a corresponding specialized settlement mechanism.Community,as the basic organization,has played a unique role in the family dispute settlement.But with the social development,the establishment of specialized family dispute settlement mechanisms becomes increasingly important in the community.Based on Chinese national conditions and others experience,the author holds that we establish a specialized family dispute settlement organization among the People＇s Mediation Committee,which collaborate with the community to establish a mandatory mediation system,coordinate between the mediation and litigation.
