摘　　要：通过对公安部最新修订的《机动车驾驶证申领和使用规定》中关于驾驶证注销制度进行分析,指出该规定违反了《道路交通安全法》及其实施条例以及《行政许可法》等上位法的多项规定,建议尽快对其进行修改,以维护我国法律的尊严和司法的统一。The article makes an analysis of the provision about revocation of driving license in Provisions on the Application for and Use of Motor Vehicle Driving Licenses newly amended by the Ministry of Public Security and points out that the provision is in violation of quite a few provisions in such super-ordinate laws as Road Traic Safety Law, its Enforcement Ordinance and the Administrative Permission Law. The author suggests that the provision should be revised as soon as possible so as to have uniform standard in judicial practice and maintain the dignity of the law.
