摘　　要：技术措施是在网络数字背景下产生的新兴著作权保护工具,其在对权利人权利保护之余也不可避免地对著作权法传统的合理使用制度造成损害。为减少损害,保护合理使用制度的立法目的,其中的重要途径就是厘清合理使用的性质,排除不正确的"权利否定说"误区,确立合理使用的权利属性。权利化的合理使用宜以一般条款的形式宣示于合理使用的法条体系中。并从权利的积极适用和消极适用两个角度构想合理使用权的实践图景。In the background of network digital technology,technical measures are copyright protection tool.However,it also inevitably damages the traditional copyright law system.There are various solutions including clarifying the nature of fair use while excluding the incorrect theory and determine the rational of fair use right,which is significant to reduce damage and protect the legislative purpose of fair use.The fair use is a kind of right should be regarded as a general provision covered in the copyright provisions system.By comparing the positive application and negative application of the fair use right,people could be well aware of the right of fair use of copyright in practice.
