摘　　要：互联网技术的成熟促使电子商务成为一种新兴交易方式。电子商务与假冒产品的结合导致了网络假货的产生。知识产权制度为企业品牌提供了制度保障,同时为打击假冒品牌提供了法律依据。知识产权既是网络假货的制度根源,又是治理网络假货的制度基础。治理网络假货必须完善知识产权制度并严肃执法。The maturity of internet technology prompts electronic commerce to be a new way to trade. The combination of counterfeit and electronic business leads to online counterfeit. Intellectual property institution provides a system guarantee for enterprise brand and a legal basis to fight against the fake brand. The intellectual property institution is not only the system root of online counterfeit, but also the institution foundation to radical online counterfeit problems. It is necessary to perfect the intellectual property institution and strictly execute it in order to radical online counterfeit problem.
