摘　　要：立法原则包括基本原则和具体原则。其中法治原则、民主原则、科学原则不仅是指导一切法律创制的基本原则,同样也构成了社区矫正立法的基本原则。社区矫正法立法,除了要遵循这些基本原则外,同时又要坚持那些体现社区矫正特色,反映刑罚与社区矫正功能和作用的具体原则,这些具体原则应当包括统一性原则,分类管理的原则,制衡的原则,社区矫正形式多样化的原则和突出程序保障原则。The principle of legislation including the basic principles and specific principle.One of the principles of the rule of law,the principle of democracy,scientific principle is not only a guide to all legislative principles,also formed the community correction law basic principle.Community correction law legislation,in addition to these basic principles,but also insisted that the embodiment of community correction characteristics,reflecting the penalty and the community correction function and the role of specific principles,these principles should include the principle of unity,classification management principle,balance principle,community correction form diversification principle and highlight the principle of procedure guarantee.
