从宪法学角度分析迁徙自由权

摘　　要：迁徙自由权是现代国家公民享有的重要的基本权利,已经得到国际社会的普遍认同。迁徙自由权同自由权和平等权关系密切。我国现行宪法并未规定迁徙自由权,而现实存在的户籍管理制度又严格限制公民享有这项权利,不利于我国经济发展和改革深入进行,建议以宪法解释的方式在我国宪法中确立迁徙自由权的地位。The freedom of migration is an important basic right granted to the citizen in modern society,and it has obtained the general acceptance of international society.The freedom of migration has a close relation with the freedom and right of equality.China＇s constitution does not mention it,but the census register system strictly limits the citizen to enjoy this right,which will damage our economic development and the reform.The authors suggest establishing the freedom of migration in our constitution by the ways of interpretation.
