摘　　要：我国尚未制定独立的军事刑法典,军事犯罪与刑罚纳入普通刑法典,军事犯罪在刑罚适用上仍然遵循普通刑罚种类的规定和相关规则。军事犯罪有其特殊规律及处罚方法,为更好地贯彻罪刑相适应原则,实现军事刑罚的专门化,本文拟对军事刑罚种类的体系性地位及具体设置进行试探讨,以求完善目前立法体例下的军事刑罚形式。An independent military penal code has not yet been legislated in China. Military crimes and criminal penalty are included in the common criminal law, and military crimes still follow the common penalty provisions and related rules. But military crimes have special rules and corresponding penalty methods. In order to fullfill the principle of a legally prescribed punishment for a specified crime better and realize the military penalty specialization, this paper tries to discuss the status and setting functions of the kinds of penalty in the military penalty system, for the purpose of improving the military penal form in the present law system.
