论我国撤销父母监护制度的提起主体

摘　　要：《未成年人保护法》规定了人民法院可以根据有关人员或者有关单位的申请,撤销不履行监护职责的父母的监护资格。但是相关立法没有明确规定申请的有关人员和有关单位的范围,致使上述规定难以操作。考察域外司法,既有设立专门机构主动提起撤销父母监护程序的模式,也有赋予检察机关履行上述职责的模式。综合考虑行政成本和现阶段国情,笔者建议不妨先试行由检察机关担当我国撤销父母监护制度的提起主体。The Protection Law for Juveniles stipulates that people~ court can rescind the guardianship of the parents who do not fulfill the guardian duties according to relevant people＂ or units＂ application. Relevant laws have not dearly stipulated the scope of related people and units, therefore, it is difficult to carry out the above regulations. The abroad laws have the modes of setting up special organizations to actively submit rescinding parents＇guardianship and endowing the procuratorate organs with the power of fulfill the above duties. Taking the administrative costs and current national condition into account, this paper suggests that taking procuratorate organs as the submitting subject of our country~ re- scindintt narents＇mlardian swte.m can ~ nut intn nractit~ an rt tri^l hA^i~t
