摘　　要：在农地确权的具体实践过程中,自上而下的确权政策表达遭遇到多方面的抵制,导致确权实践的"被产权"逻辑。即一方面政策实践脱离农村社会实际和农民需要,表现出浓厚的行政命令色彩;另一方面,作为政策实施对象的农村和农民被动接受政策,不得不用某些策略性方式纠正政策内容与实际需要的背离。具体而言,基层治理原有秩序机制、村庄社会运作逻辑和农民的土地认知结构等成为形塑"被产权"实践的主要因素,诸种反制因素在政策执行过程中起消极作用,但是契合当前农村社会现实和农民实际需求,具有实质合理性。在与制度环境不相适应的情况下,依靠产权制度孤军深入,往往陷入"头疼医脚"的实践困境,损害而并非保障农民利益。In the actual process of farmland property right reform, the expression of top-down property right poli- cies has encountered many resistances, which resulted in the ＂being propertied＂ logic. To put it in other words, on the one hand, the concerned policies with a hue of bureaucratic order were deviated from the social reality and the need of peasants ; on the other hand, as the targets of the policies, peasants and local units passively accept- ed the policies, which made it necessary to redress the policy deviations in a tactful manner. In concrete terms, grass-root management of former systems, the rural society management logic and the peasants land ownership cognition had become the principal factors influencing ＂being propertied＂ practice. Many counter factors played a passive role in the policy implementation, but they have ibility with the system environment, the mere reliance on an inward rationality. Under the situation of incompatownership would make us trapped in a predicament of erroneous positioning of the treatment in the practice and as a consequence injure the interest of peasants.
