摘　　要：立法伦理作为对法之创制活动的应然性规定,具有从"源头"上确保法治成为善治的重要意义。在向度上,立法伦理表现为所立之法应该符合形式合理性和实质合理性两个要件。而通过法之创制使价值形态的道德内蕴于法律之中,将一定的规范形态的道德转换为法律规范,则是立法伦理实现的两个方面。As the should-be requirement of the law＇s poiesis,the legislative ethics is of significance in guaranteeing law to be well-governed from the ＂source＂.In dimension,the legislative ethics is manifested as formal rationality and substantial rationality to which the laws made should conform.The morality of value form is to be implied in the law by means of poiesis and the morality of certain specification form is to be transformed as legal provisions,which are the two aspects that the legislative ethics could be realized.
