摘 要:本文从政治、经济、社会、法律、行政管制等方面探讨了拆迁中房地产权利消失的本意与性质,简要分析了被拆迁房屋的权利类型及利益实现特点,进行了如下创新:提出拆迁造成房地权利消失的概念,分析房地产权利消失经济学原理;提出房屋拆迁应当遵守的基本原则,这是拆迁管理的起点;指出拆迁补偿的实质是房地产权利消失的赔偿;分析了房地产权利价值的成因,指出房地产的物质属性与房地产权利的实质物属性;提出房地产权利消失经济学假说,拆迁中房地产权利消失经济学要素可以区分为人、物、环境、资产价值与生产价值五个方面;分析"拆迁"与"拆除"概念的异同与含义,指出应该以"拆除房屋"代替"拆迁房屋"。This dissertation discusses the definition and properties of the disappearance of real es tate rights in relocation from the aspects of politics, economics, society, law and administration and briefly analyzes the types and benefit characteristics of the removed houses. The following are the creative points: put forward the concept of disappearance of real estate rights caused by relocation and analyze the economics principle of the disappearance of real estate rights; put forward the basic principles in housing relocation, which are the starting point for relocation management;the essence of relocation compensation is the compensation for the disappearance of real estate rights; analyze the reasons of the value of real estate rights and point out the substance attributes of real estate and real estate rights; put forward the hypothesis of the economics for the disappearance of real estate rights; the economics factors for the disappearance of real estate rights in relocation can be divided into five aspects of people; analyze the similarities and differences and definition of the concepts for "relocation" and "removal" and point out that "housing relocation" should be replaced by "housing r emoval"
