构建我国农村土地信托制度的法律思考

摘　　要：西方土地信托制度在促进土地资源保护和土地流转方面贡献突出,从推动我国农村地区土地健康、有序流转的视角出发,构建符合我国国情的土地流转新制度——农村土地信托制度符合当前社会经济发展的客观规律,能够在制度层面有效解决目前我国农村土地流转不畅、流转不规范等现实问题,从根本上保护农村土地承包权人的合法利益。The purpose of this article is to explore the necessity of carrying out land trust system by studying the experiences of foreign land trust system, in order to impulse and regulate the rural land transfer in ru- ral China. Methods employed in this paper include data studys which is based on the foreign academic re- search works, Empirical analysis and Standard research. Results indicates that the Chinese land revolution a- chieved remarkable consequences, but still requires specific laws and regulations to aid the healthy develop- ment of rural land transfer. By introducing land trust into land transfer, the situation will be significantly im- proved. It is concluded that learning the essential features of land trust system assist the further development of Chinese land transfer and hopefully bring the income level of peasants up to the next stage, which is also the final concern of the issue of agriculture, countryside and farmer in China.
