日本数字出版法律制度的现状与趋势

摘　　要：日本数字出版产业的发展仅次于美国,处于世界领先地位。日本数字出版法律制度适应数字化趋势以推动文化产业发展,同时具有版权制度更新与《世界知识产权版权公约》和《世界知识产权组织表演和录音制品条约》同步、政府介入补偿金制度和强制许可制度、著作权法与国际条约和其他法律协同调整的特点,并呈现加强对权利人权利的保护、合理关照公众利益、高度重视著作财产权、力图确认出版社法律地位的发展趋势。Japan＇s digital publishing industry is in a leading position, only second to America＇ s. Japan＇ s digital publishing laws try to adapt to the digitalization trends and to promote the cultural industry＇ s development, meanwhile they have characteristics such as updating the copyright system and synchronizing with WCT and WPPT; government intervention in compensation and compulsory license systems; coordinated adjustment of copyright laws with internationa{ treaties and other laws. Besides, Japanese digital publishing laws present tendencies as follows： strengthening the protection of copyright owners; giving rational consideration to public interests; attaching great importance to property rights and confirming the legal status of the presses.
