摘　　要：近年来，中国对外直接投资发展势头迅猛。与之相伴的是，走出去企业遇到的风险逐渐加大，遭到的歧视也逐渐增多。虽然企业应对自身对外投资负主要责任，但中国政府也应该主动出击，积极参与建立全球性多边投资协议，在保障中国企业对外直接投资正当权益的同时，为国际直接投资体系的建立与健全做出发展中大国应有的贡献。In the past few years, Chinese outward direct investment (ODI) has expanded strongly. Meanwhile, risks and discriminations are becoming increasingly serious problems facing Chinese enterprises engaged in ODI activities. Although enterprises should take full responsibility for their ODI decisions, the Chinese government can and should get more active in protecting the legitimate rights and interests of Chinese enterprises overseas. It should take the initiative to actively participate in the establishment of a global multilateral investment arrangement, which can help guarantee the interest of Chinese overseas investments while China plays the role of a major developing country to contribute to the improvement of the current system of international direct investment.
