摘　　要：通过对金融商业方法专利管理各环节的梳理,得出金融领域正积极进行商业方法专利的布局和战略运用。虽然已有研究表明商业方法专利对创新绩效的影响并不显著,但实践中金融机构仍在积极进行专利活动。在实施的过程中应遵守各方利益平衡的原则,同时学术界也在寻找更科学的专利绩效的测量指标和方法。Based on the analysis of each section of patent management, this paper finds that the financial sector is actively applying business method patent layout and its strategy. Although studies up to now have shown no significant relationship between business method patent and innovation achievements, financial institutions are actively carrying out patent activities in practice to gain profits, as well as first - mover advantages and reputation. Enterprises should follow the principle of balancing all parties involved, while scholars are looking for more scientific measurements and methods of assessing performance of business method patent.
