体育人身侵权行为若干问题探微

摘　　要：体育人身侵权行为是指参与体育运动主体违反法定义务或正当操作要求而使公民人身遭受损害的行为,具体表现为侵害体育人格尊严权、体育生命健康权、体育人身自由权、体育隐私权、体育荣誉权等;其构成要件为加害行为违法性、体育人身损害事实、违法行为与体育人身损害事实之间的因果关系、行为人存在过错四个;其归责实用过错原则并兼顾公平责任和无过错原则。有效预防体育人身侵权行为的发生和要从体育本身和法律制度两方面着手形成统一的联防机制。Sports personal tort refers to the action of sports participation subject, which violate statutory duty or proper operation requirement and make people suffering. Specific performance ineluees invade sports right of personality dig- nity, sports right of life and health, sports right of personal freedom, privacy, and sports right of honor. The consti- tute elements contains the illegality action, fact of damage, the causal relationship between the illegal behavior and sports injury, behavior of human existence fault. Its responsibility applies principle of fault, fair and without fault. Ef- fective prevention of sports personal tort need to form a unified defense mechanism from the sports itself and the legal system two aspects.
